Wouldn’t having giant green ogre-like creatures called “Shreks” prompt a “Cue the Attorneys”?
Yes, EXCEPT… if I were the IP holder, I wouldn’t even want to admit that my IP inspired this.
I could see it going either way. On the one hand, it might be sort of like how Aerosmith tried to claim that the writers of This is Spinal Tap must have bugged their tour bus, until someone convinced them that there was no amount of money worth telling the world that you think the members of Spinal Tap were based on you.
On the other hand, takedown orders are a thing, and getting one on this cover would serve not only the value of your IP but the good of humanity in general.
