People who steal photos must not care if their books get stolen… Oh, wait. They DO have a (c) inside! So – rules don’t apply to them.
Why not just take your own picture with your phone and use that? You can have a similar shot without the copyright problem. I am sure the person has access to some photo capable device and there are free photoshop alternatives to fix the picture once you take it and upload it.
Time for a new cover design.
